Terms of service

1. GENERAL

1.1. These terms of use regulate the legal relationships arising between Baltic Techinvest OÜ, registry code 10889115 (Entrepreneur) and the person making the purchase (Customer) when buying and selling products and accessories of the brands: Marina Rinaldi, Elena Miro, Luisa Viola, Per te by Krizia in the sales environment (e-shop) of www.mr-plussize.com.

1.2. In addition to these terms, the legal relationships arising from the distribution of products through the e-shop are regulated by the laws of the Republic of Estonia.

1.3. The Entrepreneur may change the terms of use of the e-shop and the prices of products and services. Changes will be notified in the e-shop environment and the changes will enter into force from the publication on the website www.mr-plussize.com. The terms and prices valid at the time of the transaction will be applied to the transaction.

1.4. The selection of products, prices and discounts may differ from the selection of products, prices and discounts in the Company's retail stores.


2. PRICE

2.1. The prices of the products are listed on the product page and include the 20% VAT valid in the Republic of Estonia.

2.2. The price of the products is added to the price of the products according to the delivery method selected by the Customer during the order process, unless otherwise stated. The delivery method is selected and the delivery fee is calculated in the shopping cart.

2.3. If there is a discount code, the product discount is calculated after entering the discount code in the shopping cart.

3. ORDERING

3.1. The Customer adds the product to the shopping cart after selecting the product and, if necessary, the size on the product page, using the "Order" button.

3.2. In the shopping cart, it is possible to change the quantities and remove products from the shopping cart until the product is paid for.

3.3. To place an order, the necessary data must be entered in the shopping cart, select a payment method and press the "Send order" button.

3.4. The order is considered to be finally completed after pressing the "Send order" button and receiving payment.

3.5. The Entrepreneur will send a notification of order confirmation to the Customer's e-mail address.

3.6. In the absence of the Product ordered by the Customer, the Entrepreneur will cancel the order. The order may be canceled in part or in full. The Customer will be immediately informed of the canceled order. In the event of a partial cancellation, the Entrepreneur may ask the Customer's wishes for the remaining order - whether to ship it or cancel it as well.


4. PAYMENT

4.1. The Customer pays 100% in advance for purchases made in the online environment (e-shop).

4.2. Orders can be paid for by credit and debit card and by transfer based on invoice.

4.3. Payment takes place outside the e-shop in a secure environment. The entrepreneur does not have access to the customer's bank details.

4.4. After placing the order and paying for the goods, the Customer will receive an order confirmation by e-mail.

5. DELIVERY OF PRODUCTS TO THE CUSTOMER

5.1. The e-shop delivers products within the Republic of Estonia.

5.2. The products are delivered to the customer as Omniva parcel parcel terminal services and as services provided by Itella SmartPOST OÜ. Shipments can be tracked in the Omniva (formerly Estonian Post) tracking environment at www.track-trace.com/post. In the Itella SmartPOST shipment tracking environment at uus.smartpost.ee/saadetise-otsing. If desired, the Customer can pick up the ordered goods at the Entrepreneur's store.

5.3. The Customer pays the costs associated with the delivery of the Products.

5.4. The Entrepreneur fulfills orders, i.e. hands over the order to the postal service for dispatch no later than three working days after confirming the order.


6. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE OF PRODUCTS

6.1. The Customer has the right to withdraw from the transaction within 14 calendar days by submitting a written application to the Entrepreneur (by post or digitally signed) or in a reproducible form (e-mail).

6.2. The Entrepreneur confirms receipt of the withdrawal application by sending a notification to the Customer.

6.3. The Customer is obliged to return the product within 14 calendar days from the date of submission of the withdrawal application.

6.4. In the event of withdrawal from the transaction, the Entrepreneur shall refund to the Customer the amounts paid by him, except for the cost of delivering the product to the Customer, by transferring the refunded amount to the Customer's bank account no later than 14 days after the product reaches the Entrepreneur. The Entrepreneur has the right to delay the refund of the paid amounts until the Customer has returned the product. When exercising the right of withdrawal, the Customer shall bear all direct costs related to the return of the product.

6.5. For hygienic reasons, the right of withdrawal does not apply to laundry products, sundresses, tights and socks that have been removed from a closed package.

6.6. The Customer has the option to exchange the product within 14 days of receipt if the ordered product size did not fit.

6.7. If the product returned to the Entrepreneur cannot be exchanged due to the lack of the Customer's desired size, the Entrepreneur will contact the Customer.


7. SUBMISSION OF A CLAIM

7.1. In the event of deterioration of the condition of the item to be returned, the Customer shall be liable for any decrease in value due to use only if the Customer has used the item in a manner other than that necessary to ascertain the nature, properties and functioning of the item. In order to ascertain the nature, properties and functioning of the item, the Customer should handle and use the item only in the manner in which he would normally be allowed to do so in a store. For hygienic reasons, the right of withdrawal does not apply to laundry products and sundresses taken out of sealed packaging.

7.2. If defects are discovered in the product, the Customer undertakes to notify the Entrepreneur immediately, but no later than 2 months after becoming aware of the defect, by sending the relevant information to the e-mail address info@mr-plussize.com.

7.3. In the event of a product that does not comply with the contract or is defective, the Customer has the right to demand that the Entrepreneur fulfill its obligation, withdraw from the contract or terminate the contract.

7.4. In the event of non-compliance or a defect of the product, the Customer has the right to demand that the product be repaired or replaced with a product that complies with the requirements and is free from defects or to return the product at the expense of the Entrepreneur.
The Customer has the right to demand a reduction in the purchase price of the product or termination of the contract and the recovery of the amounts paid for the product if:

  • The Entrepreneur is unable to repair or replace the product or
  • The repair or replacement of the product fails or
  • The Entrepreneur has not eliminated the defect in the product within a reasonable time or

7.5. In the event of a return of a non-compliant product, the Customer will be reimbursed the amount paid for the product, including the cost of transportation, to the bank account indicated by the Customer within 14 days at the latest. The Entrepreneur has the right to delay the refund of the amounts paid until the Customer has returned the product in his possession.

7.6. The Entrepreneur will not reimburse the Customer for the costs incurred in the event of non-compliance or defects of the product and will not be liable for them if:

7.6.1. The value of the product has decreased/the product has been damaged due to the fault of the Customer;
7.6.2. The defects have arisen as a result of the product being used for purposes other than its intended purpose, including failure to follow the maintenance instructions;
7.6.3. The value of the product has decreased due to natural wear and tear during normal use;
7.6.4. There is no copy of the document proving the purchase.

7.7. In the event that disagreements have arisen between the Customer and the Entrepreneur regarding the defects of the product, the Customer has the right to file a complaint with the Entrepreneur, stating their name and contact details, the date of the complaint, the defect in the product and their proposed solution in the complaint submitted in writing or in a form that can be reproduced in writing (e-mail). The Entrepreneur shall respond to the Customer's complaint in writing or in a form that can be reproduced in writing (e-mail) within 15 days. If the buyer has any complaints regarding the online store, they must be sent to the e-mail address info@mr-plussize.com.

7.8. If the Customer and the Entrepreneur do not reach an agreement on the dispute, the Customer has the right to seek out-of-court settlement of the dispute: in Estonia - to the Consumer Disputes Commission operating at the Consumer Protection Board (www.komisjon.ee), in Europe - to the Online Dispute Resolution platform for resolving consumer disputes in the European Union at ec.europa.eu. The review of the Customer's complaint by the Commission is free of charge. The resolution of disputes by the Consumer Protection Board in Estonia is based on the laws of the Republic of Estonia.

7.9. If the parties disagree with the decision of the Commission, the parties have the right to appeal to the county court of the location of the Entrepreneur.
